1. ELIGIBILITY. The Sweepstakes is open to legal residents of and who currently reside in the 50 United States (including District of Columbia), are 18 years of age or older at time of entry, who have access to the Internet throughout the Sweepstakes and are Yamaha Online EasyPass members. Employees of Yamaha Corporation of America ("Yamaha") and its respective parents, subsidiaries, affiliates and their immediate family members (spouse, parents, children and siblings and their respective spouses) are ineligible to enter and win. Void where prohibited by law, regulation and ordinance, and in U.S. possessions and territories. By participating in this Sweepstakes, entrants agree to these Official Rules, Yamaha's Privacy Policy and EasyPass, as stated herein.

2. ENTRY. There are 2 ways to enter during the live broadcasts of CELEBRATE YOUR MUSIC WITH YAMAHA available and submitted at www.yamaha.com/thehub (the "Website") through Yamaha Online EasyPass ("EasyPass"). All information requested on EasyPass must be submitted to be an eligible entry. Entries will be accepted for the first 30 minutes during each of the live broadcasts on October 30, 2009, December 7, 2009, December 18, 2009 and January 17, 2010.

1. ENTRY OPTION #1 - You must text the keyword to the designated cellular (SMS) number provided during the live broadcast of CELEBRATE YOUR MUSIC WITH YAMAHA only available at www.yamaha.com/thehub. Once the valid keyword is presented during the broadcast, you can automatically receive one entry by simply texting the keyword as instructed using a text messaging capable mobile phone from a participating carrier Participating carriers are: AT&T, T-Mobile, Verizon Wireless, Alltel, Virgin, Boost, Nextel, Cellular South, US Cellular, Rural Cellular, East Kentucky Network, Cellcom, Immix Wireless, Cincinnati Bell and nTelos. Standard text message rates apply to each text message sent and received. Normal time, toll, connection and usage rates, if any, charged by your mobile service provided or internet service provider will apply.


2. ENTRY OPTION #2 - You must click the "ENTER TO WIN" button located on your screen during the live broadcast of CELEBRATE YOUR MUSIC WITH YAMAHA only available at www.yamaha.com/thehub. Once the valid keyword is presented during the broadcast, you can automatically receive one entry by simply clicking the "ENTER TO WIN" button.

Limit one entry per broadcast, up to a maximum of four entries per email address. All entries will become the property of Yamaha.

3. WINNER SELECTION. A total of five winners will be chosen by random drawing from all eligible entries received by Yamaha; one winner will be chosen during each of the CELEBRATE OF YOUR MUSIC WITH YAMAHA broadcasts on October 30, 2009, December 7, 2009, December 18, 2009, and January 17, 2010 and announced at the end of the broadcast; one Grand Prize winner will be chosen at the end of the CELEBRATE YOUR MUSIC WITH YAMAHA broadcast on January 17, 2010.

4. NOTIFICATION AND ACKNOWLEDGEMENT. The winner will be notified by email, SMS text, or telephone to entrant's information submitted to Yamaha, within 30 minutes of the drawing, and the winner must respond to Yamaha's notification within 1 day or prize winner will be disqualified, the prize will be forfeited and an alternate potential winner may be selected by random drawing. If the prize notification is unclaimed or returned as undeliverable, or in the event of noncompliance with these Official Rules, the prize will be forfeited and may be awarded to an alternate winner. Prize winner may be required to sign an Affidavit of Eligibility and Liability and Publicity Release. The prize winner is responsible for all federal, state and local taxes and other costs pertaining to the awarded prize. The prizewinner agrees to allow Yamaha to use the winner's name (whether in print publication, online or other means of communication), without compensation to notify the public of their winnings.

4. PRIZES AND THEIR VALUE. The following prizes will be awarded:

Prizes - During each of the 4 broadcasts of CELEBRATE YOUR MUSIC WITH YAMAHA, a YAMAHA Pocketrack will be awarded by random drawing. At the end of the January 17, 2010 broadcast, one Grand Prize winner will be awarded a YAMAHA YHT-390 Home Theatre System and a Disneyland® Vacation Package which consists of the following: Four 3-day Disneyland® Resort Park Hopper® tickets for the Disneyland® Resort located in Anaheim, California (the "Resort"); standard hotel accommodations for a one-room (quad occupancy), two-night stay at a Resort hotel; Four round-trip coach airfare tickets from a metropolitan airport nearest Winner's home to an airport in Southern California (as chosen by prize supplier) and ground transportation to/from the Southern California airport and the Resort for the Winner and his/her three designated guests. If in the judgment of Sponsor air travel is not required due to Winner's proximity to prize location, ground transportation will be substituted for round trip air travel at Sponsor's sole discretion. All expenses not specifically mentioned herein are not included in the prize and are solely the Winner's responsibility, including but not limited to round trip transportation between the Winner's residence and the metropolitan airport nearest Winner's home, hotel room service, parking fees, laundry service, food, beverages, merchandise, souvenirs, local and long distance telephone calls, tips, gratuities and service charges. Airline carrier's regulations and conditions apply. Travel and lodging are subject to availability, certain restrictions and blackout dates apply and must be booked at least forty-five days prior to the date of arrival at the Resort. Saturday night stay may be required. The Vacation Package awarded must be completed by September 30, 2010. Prize Winner and companions must participate in the trip together on same dates; and any minor must be accompanied on the trip by his/her parent/legal guardian. The Winner and his/her guests will be required to complete and return to Yamaha a waiver indemnifying Yamaha, Disney Destinations, LLC and their affiliates from any and all liability related to the awarded prize. Failure to do so will result in disqualification and an alternate award recipient will be selected. The Yamaha musical instrument comes with available manufacturer warranty.

The approximate retail value of the prizes to be awarded in this Sweepstakes is $4699 (MSRP). Retail value is subject to change without notice to entrants. No prize substitutions, cash equivalent or transfer of prizes permitted except at the sole discretion of Yamaha. Prizes are subject to restrictions and may not be used in conjunction with any other promotion or offer. Winners will be identified during the live broadcast and/or later on Yamaha's Website. Winners will receive an IRS form 1099 from Yamaha. Yamaha is not responsible for lost or misdelivered prizes due to entrant's inaccurate or improper address information. Yamaha is not responsible for lost, stolen or damaged prizes, once received and in the possession of prizewinner. Incomplete, untimely, unreadable, garbled, lost, misaddressed or misdirected entries will be disqualified.
Prizes may not be exchanged for cash or otherwise, except that Yamaha retains the right to substitute prizes of equal or greater retail value.

5. INTERNET. If, for any reason, Yamaha is unable to conduct this Sweepstakes as planned due to technical failures, such as those caused by a computer virus, hacking, other unauthorized interference, fraud, or any other cause beyond the control of Yamaha which obstructs or otherwise adversely affects the proper administration, reliability, fairness, or integrity of the Sweepstakes, Yamaha reserves the right, at its sole discretion, to disqualify any person found to have interfered or tampered with the Sweepstakes, and if deemed necessary by Yamaha in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. Yamaha assumes no responsibility for any failure in transmission, however caused, including any omission, interruption, deletion, defect, communications line failure, theft or destruction of information or unauthorized access to entries, their damage or alteration. Yamaha is not responsible for its failure to receive any email or entry due to software failure, technical problems, human error or transmission congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an Entrant's, or any other person's, computer relating to or resulting from participation in this Sweepstakes or downloading of any materials in this Sweepstakes. CAUTION: YAMAHA RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER PENALTIES, OR REMEDIES, TO THE FULLEST EXTENT PERMITTED BY LAW, FROM ANY PERSON(S) ATTEMPTING TO DELIBERATELY INTERFERE WITH THE CONDUCT OF THIS SWEEPSTAKES OR TO DAMAGE THE WEBSITE.

If a dispute arises over the identity of the person who transmitted an entry via an identified email address, the "Authorized Account Holder" of the email address submitted at time of entry will be deemed to be the Entrant. The "Authorized Account Holder" is defined as the natural person assigned to an email address by an internet access provider, online provider or other organization (e.g. business, education institution, etc.) responsible for assigning email addressees for the domain associated with the submitted email address. Any entry sent through the use of an automated sending device will not be accepted and will not be considered a valid entry.

6. PRIVACY. Except as provided above, all personal information supplied by Entrants will be subject to Yamaha's Privacy Policy, which is located at www.yamaha.com/privacypolicy.asp

7. RELEASE. By participating in this Sweepstakes, all entrants and prize winners release, discharge, and hold harmless Yamaha Corporation of America, its parent company, Yamaha Corporation, Disney Destinations, LLC, and their respective partnerships, subsidiaries, divisions, branches, affiliates, assigns and agencies, including, without limitation, their respective officers, directors, shareholders and employees (collectively "Released Parties") from and against any and all liability or claims for any and all legal claims, injury, loss, illness, litigation or damages arising out of their participation in the Sweepstakes and/or the acceptance, use, misuse, non-use or possession of the prize. Any portion of the prize not accepted by Winner will be forfeited, and the Released Parties are not responsible for any inability of the Winner to accept or use the prize (or portion thereof) for any reason. Released Parties are not responsible for printing or typographic errors in any Sweepstakes or related material or for stolen, lost, late, misdirected, damaged, incomplete, postage due, and/or illegible entries or mail. If, in Yamaha's opinion, there is any suspected or actual evidence of a virus, bug, tampering, unauthorized intervention, fraud technical failures or other causes beyond Yamaha's control corrupt the administration, securities, fairness integrity or proper play of the Sweepstakes and award the prize from all eligible entries received to date tampering with any portion of the Sweepstakes, Yamaha reserves the right in its sole discretion to disqualify any individual and/or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and award the prize using all non-suspect eligible entries received as of the date of such action. In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, participants agree that the dispute shall be resolved by applying the laws of California and that it shall be resolved by and within the courts of that state.

8. GENERAL CONDITIONS. All federal, state and local laws apply. Yamaha Corporation of America is the final interpreter of these Official Rules. The decisions of Yamaha are final in all matters relating to the Official Rules. By participating in this Sweepstakes you agree to the use of your name, photograph, likeness and/or identity for advertising, publicity and promotional purposes, without compensation, unless prohibited by law. You will also be added to Yamaha's mailing list subject to Yamaha's Privacy Policy and opt-out provisions.
